Democracy Forward Foundation brings this action challenging the U.S. Office of Personnel Management’s, the General Services Administration’s, the Department of Housing and Urban Development’s, and the Office of Management and Budget’s failure to comply with public records laws. The complaint alleges that defendants unlawfully withheld documents concerning the use of artificial intelligence (AI) in implementing the Trump-Vance administration’s deregulation agenda. Plaintiff alleges that this withholding violates the Freedom of Information Act (FOIA) by denying the public access to information necessary to understand and evaluate government use of AI in regulatory processes. Plaintiff seeks declaratory and injunctive relief compelling the agencies to release the requested records and comply with federal public records laws.
