Legal Action

A university professor filed suit to compel the release of records from the U.S. Census Bureau and the U.S. Department of Commerce related to testing of sexual orientation and gender identity (SOGI) questions on the American Community Survey (ACS). Plaintiff challenges the agencies’ unlawful withholding of data from the 2024 ACS SOGI Test, arguing that the information is essential to evaluate the inclusion of SOGI questions in the nation’s primary demographic survey. The plaintiff contends that the withholding violates the Freedom of Information Act (FOIA), which requires timely disclosure of non-exempt public records. The lawsuit seeks injunctive relief ordering the agencies to process and release the requested data and related reports in full compliance with FOIA.
