Gonzalez v. Gor

Filed in: U.S. District Court for the District of Puerto Rico

Summary

Members of the Federal Oversight and Management Board for Puerto Rico bring this action against the Trump-Vance administration after being summarily removed from their positions by the Presidential Personnel Office. Plaintiffs allege their removals are unlawful because Congress expressly provided that Board members may be removed only “for cause” under 48 U.S.C. § 2121(e)(5)(B). They argue that the President lacks constitutional authority under Article II to remove territorial officers, as the Supreme Court has held that Oversight Board members are territorial officials created under Article IV. Plaintiffs seek declaratory and injunctive relief, or in the alternative, a writ of mandamus, to reinstate them and prevent further unlawful removals.
