Legal Action
Housing Authority of the County of San Diego v. Turner
Filed in: U.S. District Court for the Northern District of California
Summary
Plaintiffs, a coalition of public housing agencies and local governments, bring this action challenging the U.S. Department of Housing and Urban Development’s (HUD) imposition of new, unauthorized conditions on federal housing grants essential to their communities. Plaintiffs allege that Defendants’ actions exceed their constitutional and statutory authority by coercing compliance with executive policy preferences through vague and unlawful grant conditions. They claim these actions violate the Spending Clause, the Fifth Amendment’s void-for-vagueness doctrine, and the Administrative Procedure Act. Plaintiffs seek declaratory and injunctive relief setting aside HUD Notice Public and Indian Housing (PIH) 2025-22 and prohibiting Defendants from enforcing the new grant conditions or withholding funding.
