Summary

Immigrant advocates sued the Trump-Vance administration to challenge Executive Order 14159, “Protecting the American People Against Invasion,” which expands the scope of the expedited removal process. The executive order would allow expedited removal to be carried out against any migrant in the United States who cannot prove that they have resided in the country for more than two years. The plaintiffs argue the executive order is unconstitutional and should be rendered unenforceable.

On January 22, 2026, this case was consolidated under Make the Road v. Noem, 1:25-cv-4455.
