A coalition of states and public energy agencies brings this breach-of-contract action challenging the U.S. Environmental Protection Agency’s (EPA) unilateral termination of competitive grants awarded under the Solar for All zero-emissions technologies program. Plaintiffs allege that the EPA’s cancellation of their grant agreements and withdrawal of obligated funds constituted a clear and material breach of contract. They contend the agency’s actions were unlawful because they exceeded its statutory authority under the Inflation Reduction Act and violated the terms of the Clean Air Act, 42 U.S.C. § 7434. Plaintiffs seek money damages for the EPA’s breach and any other appropriate relief restoring their grant funds.
