Summary

A group of transgender individuals filed a lawsuit against the Trump-Vance administration challenging a new passport policy that requires sex designations on passports to reflect the sex assigned “at conception.” On January 20, 2025, President Trump issued Executive Order 14168, titled “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.” The order removed established legal recognition and protection for transgender people by requiring they be identified only by their gender at birth, which consequently prevents transgender individuals from updating their passports and government documents to reflect their gender identity. The plaintiffs in this case are citizens who have been prevented from selecting their gender identity on their U.S. passports. The plaintiffs argue the executive order violates their Fifth Amendment rights by discriminating against them on the basis of sex, infringing on their right to privacy, and curtailing their freedom of movement.
