Revolution Wind, LLC, an offshore wind energy company, challenges the Bureau of Ocean Energy Management’s (BOEM) August 22, 2025 Stop Work Order, halting construction of the nearly completed Revolution Wind offshore project on the U.S. Outer Continental Shelf, which plaintiff alleges was issued without statutory authority and in violation of established procedures. Revolution Wind claims the order is unlawful because it exceeds BOEM’s powers under the Outer Continental Shelf Lands Act, violates the Administrative Procedure Act and the Fifth Amendment’s Due Process Clause, and is arbitrary and capricious given the extensive prior environmental and national security reviews. Plaintiff seeks declaratory and injunctive relief vacating the Stop Work Order and preventing federal interference with the lawful completion and operation of the project.
