Legal Action
San Francisco AIDS Foundation v. Trump
Filed in: U.S. District Court for the Northern District of California
Summary
Plaintiffs, a coalition of LGBTQIA+ advocacy groups and community care nonprofits, filed suit against the Trump-Vance administration challenging three executive orders terminating federal grants related to diversity, equity, and inclusion (DEI) and forbidding federally-funded organizations from operating DEI programs. In the first month of his term, President Trump issued various executive orders seeking to eliminate DEI programs across the federal government, remove legal recognition for transgender people, remove DEI programming from institutions receiving federal funding. The plaintiffs rely on federal funding to carry out their mission-driven work, and had their funding terminated under the executive actions. The plaintiffs argue the orders violate their First Amendment right to freedom of speech and Fifth Amendment rights to due process and equality under the law. The plaintiffs requested that the court declare the executive orders unconstitutional and issue a permanent injunction preventing the orders from being enforced.
On Jun. 9, 2025, a U.S. district court issued an order partially granting plaintiffs’ motion for preliminary injunction. An appeal ensued, and final resolution in the circuit court remains pending.
