Society of General Internal Medicine v. Kennedy

Filed in: U.S. District Court for the District of Maryland

Summary

Nonprofit membership associations filed a lawsuit challenge the defendants’ decision to terminate Agency for Healthcare Research and Quality (AHRQ)’s grantmaking program and to withhold congressionally appropriated funds for health services research. Plaintiffs allege these actions violate the statutory requirements in 42 U.S.C. § 299 et seq. and constitute unlawful impoundment of appropriated funds as well as arbitrary and capricious agency action under the Administrative Procedure Act. They seek declaratory and injunctive relief compelling defendants to resume AHRQ’s grantmaking process and to obligate the appropriated research funds as mandated by law.
