Legal Action
State of Rhode Island v. United States Department of the Interior
Filed in: U.S. District Court for the District of Rhode Island
Summary
States and state environmental agencies bring this action challenging the Bureau of Ocean Energy Management’s (BOEM) August 22, 2025 Stop Work Order that abruptly halted construction of the Revolution Wind project. Plaintiffs allege that the Stop Work Order was issued without statutory authority, factual basis, or reasoned explanation, rendering it arbitrary, capricious, and contrary to law under the Administrative Procedure Act and the Outer Continental Shelf Lands Act. They assert that the Order unlawfully reverses prior federal approvals and undermines the States’ reliance interests in a nearly completed, fully permitted clean energy project critical to meeting their renewable energy and economic goals. Plaintiffs seek declaratory and injunctive relief invalidating the Stop Work Order and restoring authorization for the continued construction and completion of Revolution Wind.
