Overview
Democracy Forward Foundation continues to track US Supreme Court decisions that have changed the landscape of administrative law, including how litigants and courts are citing
and applying these decisions. In particular, we have closely monitored the ripple effects of Loper Bright Enterprises v. Raimondo, which overturned the longstanding doctrine of Chevron deference requiring courts to defer to agency interpretations of ambiguous statutes. Under Loper Bright, by contrast, courts must “exercise their independent judgment” to ascertain the “best reading” of statutes, even when ambiguous.
